The Melbourne Airport Third Runway Major Development Plan (M3R MDP) will soon be on its way to the federal transport minister, the Honourable Catherine King MP.

You will be aware that, in its response to the M3R MDP, the Victorian Government has the following legislated obligations with which it must comply, but as yet has not.

  1. The state Climate Change Act 2017, obliges the Victorian Government to prepare a Climate Change Impacts Assessment on the M3R MDP that models third runway-enabled global warming flight emissions.
  2. The state Environment Protection Act 2017, obliges the Victorian Government to require that Melbourne Airport adequately address its General Environment Duty to minimise the risks of harm to the environment and human health.
  3. The state Melbourne Airport Environs Overlay needs to be updated to reflect 2022 ANEF in the Melbourne Airport 2022 Master Plan.
  4. The state Major Transport Projects (Facilitation) Act 2009, allows for the preparation of a Comprehensive Impact Statement on the M3R MDP.
  5. The state Planning and Environment Act 1987, under section 151, allows for the appointment of an Advisory Committee on the M3R MDP, to provide a transparent, independent forum for the consideration of 3rd runway impacts on stakeholders.
  6. The state Environment Effects Act 1978 allows for the preparation of an Environment Effects Statement on the M3R MDP, including a Health Impacts Assessment of noise compliance with World Health Organisation Environmental Noise Guidance 2018, and air quality compliance with the state Environment Protection Act 2017.
